Terms of Service

These terms apply to work commissioned with Branchard Tree & Landscape Services (referred to as "we", "us", "our") at 10 Baffin Cl, Rugby, CV22 6TW, United Kingdom. You can reach us at branchardtreeservices@gmail.com or 07511 208277.
Quotes and acceptance
All written quotes are valid for 30 days from the date issued unless stated otherwise. Quotes are itemised and split into tree work, hard landscaping, planting and waste removal where applicable. Acceptance is by written confirmation (email, signed quote or text message), at which point a contract is formed for the agreed scope at the agreed price.
Verbal quotes given on-site are summary estimates only. A written quote will follow within 48 hours and supersedes anything said in person.
Scope and changes
The work scope is defined by the written quote. Any changes during the work (additional limbs to remove, extra waste to take away, design alterations) are agreed and priced before being carried out, normally as a written variation.
We reserve the right to refuse to carry out work that becomes unsafe during execution (for example, a leaning tree turning out to have severe internal rot) and will adjust scope or quote accordingly with you.
TPOs, Conservation Areas and consents
Where a tree is protected by a Tree Preservation Order (TPO) or sits inside a Conservation Area, we will check the council register and apply for any necessary consents on your behalf as part of the quoted price. We are not responsible for council delays or refusals. Work cannot start until consent is granted. If a refusal makes the work impossible, you will only be charged for any survey or paperwork costs incurred.
Site access and preparation
You agree to provide reasonable access to the site for our team and equipment. If access cannot be granted on the agreed day (gates locked, vehicles in the way, dogs uncontained) and we have to leave site, a re-attendance fee may be charged.
You confirm that you are the owner of the property or have authorisation to commission the work. For boundary fences, you confirm that ownership has been verified or that the boundary work has been agreed with neighbours where appropriate.
Payment
Standard domestic payment terms are 50% deposit on acceptance for projects over £2,000, with the balance payable within 7 days of completion. Smaller jobs (under £2,000) are payable in full within 7 days of completion. We accept bank transfer, cash and credit card.
Late payment beyond 30 days from completion may incur statutory interest at the applicable rate under the Late Payment of Commercial Debts (Interest) Act 1998 where the customer is acting in business capacity.
Cancellation
You may cancel the contract within 14 days of acceptance for a full refund of any deposit paid, unless work has already started at your request inside that window. If work has started, we will charge for any reasonable costs already incurred (materials ordered, paperwork submitted, time on site). After the 14-day period, deposits are non-refundable but may be transferred to a rescheduled job at our discretion.
Warranty
Our work is warranted as follows:
- Tree work: labour warranty does not apply to natural tree behaviour after work (regrowth, post-prune die-back, weather-related damage). All work is to BS3998 standards.
- Hard landscaping: 2-year workmanship warranty on patios, walls, drainage and fencing where work was carried out by us using our own materials. Materials carry their manufacturer's warranty.
- Planting: 1 growing season warranty subject to reasonable aftercare. Aftercare requirements are documented at handover; failure due to inadequate watering or maintenance is excluded.
- Stump grinding: labour warranty does not apply to natural rootwood decay or honey fungus risks; we'll discuss these on the site visit.
Insurance
We carry £5m public liability insurance and employer's liability insurance. Documentation is available on request before work starts.
Liability
Our total liability for any one claim arising from the work is limited to the contract value of that job, except for liability for personal injury or death caused by negligence (which is unlimited as required by law) and any liability that cannot be excluded under English law.
We are not liable for indirect or consequential losses, including loss of profit, loss of use or pure economic loss.
Disputes
If something isn't right, contact us first. We'll usually resolve it on a phone call or a return visit. Where a dispute can't be resolved informally, the parties agree to attempt mediation before any legal action. These terms are governed by English law and subject to the exclusive jurisdiction of the courts of England and Wales.
Changes to these terms
These terms may be updated from time to time. The version that applies to your contract is the version in force on the date you accept your quote.
